K1 Visa and the Spousal Green Card are one of the simplest ways to bring the man or woman that you love in to the USA.
Imagine having to come to the USA as shown in this video
Times have changed drastically since then and now there are many different ways to come as a immigrate to the USA. The K1 Visa is one of those ways.
One of the most confusing and yet one of the most important processes you can go through is the k 1 visa and green card process. It is typically goes by a few different names the I 129 process, k1 fiancee visa, k1 fiance visa or the USA green card through marriage process. Your fiance will need both a K 1 visa and a green card through marriage to remain in the USA. The process must follow each other within a very short amount of time.
First let us take a look at the K 1 Visa
The K1 Visa is a way to bring your fiance to the USA. There are no gender guidelines. Your beneficiary can be a man or a woman. The petitioner must be a US citizen. The forms typically start with form I-129 F. This process typically requires a number of supporting immigration visa documentation to complete the application. A good resource for all general questions can be found here USCIS.
The immigration process can be difficult to complete if you do not have experience. Potential issues that can arise are application denial or application hold for inadequate supporting documentation. My recommendation is to stick with one reputable internet sites that will help you gather the right documentation to ensure your success. Also keep in mind that not all immigration matters are cut and dry, there may certain situations where you need an attorney.
Once your application and fiance visa is approved your fiance is given a visa with a short amount of time to enter the USA. If the fiance visa expires, he or she will lose all rights to enter the USA under the current fiance visa. Once the fiance enters the USA, she or he must be married within 90 days or be subjected to deportation. This is very important to remember. You have no idea how many emails and phone calls I get concerning an expired visa.
After the wedding it is important to start on the adjustment of status. This is typically called the green card adjustment of status.
Second, The USA Green Card
Once the marriage is complete, it is important to start work on getting your new spouse a green card. The card is good for two years. After two years the spouse must apply again to have all restrictions removed. This does not mean your spouse has US citizenship or has the right to apply for citizenship, all it means is they are considered legal residents. After three years of being married, your spouse can apply for citizenship.
The immigrant spouse must still be married when reapply for the green card. This happens exactly two years after receiving the green card approval. The USCIS will not send out a reminder. It is up to the green card holder to ensure they reapply under the correct timeline. Failure to stay married may result in deportation.
The immigrant spouse must not break any laws. The breaking of even minor laws can result in deportation.
Finally the green card is not a means to claim citizenship in anyway. The immigrate spouse must still carry a current passport from his or her own country. If they wish to travel outside the USA, they must carry a current international passport from the country that holds their citizenship. To reenter the USA the immigrant spouse will need a valid US green card.
Both processes are not easy and can take up a lot of your time. It is best to use reputable internet resources or an attorney. The last thing you want to go through is have your application denied or put on hold. A good resource is K1 Visa Experts. K1 Visa Experts has it own process to help you throughout the entire process. K1 Visa Experts does not stop until your fiance has a green card in hand.
Other resources are K1 Fiancee Visa, US State Department. Finally for those that do not speak the English language well, there are websites that provide information in the native language. Here are a few resources that may help Russian-Moscow US Embassy, Romanian Moldova US Embassy, Juarez US Embassy (Espanol). There are many more. Use Google to search for the right embassy from your country and in your language.
There are other things you may want to do to prepare for when your fiance/fiancee gets to the USA. The legality of it is the easy part. Living together and getting to know each other under the same roof provides it own unique challenges. You can learn more about this in the membership articles. For example, did you know that a woman from Russia may have other beauty needs than a woman from the USA? Yes, not every woman uses the same cosmetics and methods for beauty. Another example is food, customs and traditions. Knowing your potential spouse at this level has a lot more to do with the success of your relationship than the paperwork to get them to the USA. A successful relationship in marriage will require you to focus on both.
If you have not already found your potential international beauty, then it might be time to brush up on your culture knowledge. Read up on a few good site that will give you further insight on Eastern European Women. Although you may think it is easy to find one and marry, you will be surprised on how hard it can be. Take your time and do a little research to help you along the way.
