The Fiance K1 brings a lot of joy and sometimes sadness to a couple. There are a few areas of the process that most do not talk about, yet they should. Most fiance’s that enter the U.S.A feel they are 100% reliant on their U.S Fiance. They need to do exactly what they are told or they will be deported. This mentality is not common, but can relate to a small percent of non-immigrants who enter the U.S.A. This article will discuss a few areas that are not common, yet are faced by some couples.
Scenario 1
A couple does not really know each other well. Potential U.S spouse is abusive. The non-immigrant fiance is not aware of the behavior and enters the U.S.A on a fiance K1 Visa.
Normally a fiance does not find out about a behavior like this until they become the spouse. Then the true behavior surfaces. Yet keep in mind this is not a common trait for men or women that search for fiance abroad. It is only a small few who experience what is discussed here. 99.9 percent of the time, I only hear of happy couples enjoying their lives together.
Scenario 2
A couple does not really know each other well and U.S citizen (spouse) after marriage leaves wife/husband for someone else. Since it takes two years of being married to be considered for complete permenant residence the non-immigrant spouse feels he or she needs to return home. They have built up a life here and now will need to return to where they began. It can be very depressing for them. A failed marriage is never good, yet this on top of having to return home can be devastating.
What Rights Are Entitled To The Non-Immigrant Spouse
Believe it or not, the non-immigrant spouse has a lot of rights which are granted by the United States Government. If the spouse is abused they are allowed to divorce and apply for a wavier to remain in the U.S.A and have rights to citizenship. The same goes for a man or woman that is left by their spouse.
There are many different conditions that will allow a spouse to remain in the U.S.A if they so choice to do. Many feel that they must leave and this is not entirely true. Some times things do not work out in a marriage. Yet it is not the end of the world and life can go on in the U.S.A. In the event that this happens there are avenue to help a person in need.
